These terms apply to your use of rexofficesoftware.com and any other website we operate for the REX software range (the "website"). The website is run by Energy Conscious Design Limited, trading as REX Office Software ("ECD", "we", "us"), Auckland, New Zealand. By using the website you agree to these terms; if you are using it for a company or organisation, you confirm you may agree on its behalf. If you do not agree, please do not use the website.
1.1 These terms cover browsing the website, downloading installers, manuals and other files from it, and emailing us through it.
1.2 Buying and using the software is covered by the REX Licence Agreement and Terms of Sale, and our handling of personal information by the REX Privacy Statement. Both are linked at the foot of every page. If these terms and the Licence Agreement differ about the software, the Licence Agreement applies.
2.1 You may view the website and download the files we make available for their intended use: installing and evaluating or using the software under its licence, and reading the manuals.
2.2 You must not: (a) try to interfere with the website or the systems behind it, or introduce anything harmful; (b) access it by scraping, robots or other automated means rather than a normal browser, except for ordinary search-engine indexing; (c) copy the website's text, images or design for another website or product; or (d) present any part of it as your own.
2.3 Any information you give us (for example in an order email) must be true and complete, and you must tell us if it changes.
2.4 You may link to our pages. Please do not frame them or imply that we endorse your site.
3.1 Installers and zip files are provided free to download; the software inside them needs a licence key, or the free trial for REX Accounts, to run.
3.2 We publish a SHA-256 checksum for each file so you can confirm a download is the genuine, unaltered file. The checksum is provided for your convenience; if a checksum and a file do not match, do not install it and tell us.
3.3 Files downloaded from anywhere other than this website or our download server are not ours and we are not responsible for them.
4.1 ECD owns the copyright and other rights in the website and its text, images, logos, manuals and design, and in the REX names and marks. All rights not expressly given are reserved. You may print or save pages and manuals for your own use.
5.1 We try to keep the website accurate and up to date, but it is general information about our software, not advice. Feature lists and comparisons with other products reflect what was published at the date shown and may change. Nothing on the website is accounting, tax or legal advice.
5.2 Links to other websites (for example Lemon Squeezy, Tesseract or LibreOffice) are provided for convenience; we do not control them and are not responsible for their content or terms.
6.1 We may change, suspend or withdraw the website or any part of it at any time without notice.
6.2 To the extent the law allows, we are not liable for any loss arising from the website being unavailable, slow or containing an error, from anything downloaded from it, or from any linked site. Where our liability in connection with the website cannot be excluded but can be limited, it is limited to NZ$1. Nothing in these terms limits any right you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Australian Consumer Law that cannot be excluded, or our liability for fraud or for death or personal injury caused by our negligence.
7.1 The website sets no tracking or advertising cookies and has no user accounts. What little we collect when you buy or write to us, and how we handle it, is set out in the REX Privacy Statement.
8.1 We may change these terms by publishing a new version on the website with a new version number and date. The new version applies to use of the website from the date published. Changes do not affect the Licence Agreement that applied to a purchase you have already made.
9.1 These terms are governed by New Zealand law and the New Zealand courts have non-exclusive jurisdiction. If any part is unenforceable, the rest still applies. If we do not enforce a term, we have not given it up.
